The Department has made a determination to extend the public comment period on a Draft Environmental Impact Statement (DEIS) on this proposed project to Friday, June 22, 2007. The applicant proposes the mining of sand and gravel from 69 +/- acres on a total site of 192 +/- acres. Mining and concurrent reclamation (initially as grassland) would be done in 7 phases of 10-12 acre increments. No material processing will take place and there will be no operations on weekends. Weekday operations will be limited to 7:00 AM to 4:00 PM. Investigations have determined there will be no impacts on endangered species, on-site waterbodies or wetlands, or archaeological remains. Visual and noise impact analyses have been prepared and are available for review. The location is north of Turkey Hill Road, west of the intersection with Odak Farm Road.
In addition, the project is the subject of a Draft Environmental Impact Statement (DEIS). A public hearing on the permit application and the DEIS will be held on May 10, 2007 at 7:00 p.m. at the Town of Milan Town Hall located at 20 Wilcox Circle (north of Route 199).

This permit application requests to disturb a tributary (H-101-21-6, Class B) and subtributary (H-101-21-6-1, Class C(t)) of the East Branch of the Wappingers Creek located in the Village of Millbrook, Dutchess County, for a number of activities to improve and repair stream channel structures and the dredging of two man made ponds (P3546 - Upper Pond and P388 - Lower Pond) where the dredged material will be used on site. The following work is requested: 1) dredge the Upper Pond (approx. 2,964 cu. yds. of material to be dredged) and the Lower Pond (approx. 3,883 cu. yds. of materials to be dredged), 2) remove an existing culvert, replace it with a concrete diversion weir and realign the existing swale, 3) repair and replace 220 feet of damaged riprap lining and provide new riprap lining to stabilize the stream channel, 4) repair existing stone veneer on the the masonry walls surrounding the dam and stream channel, 5) install new concrete footings at the base of the existing masonry walls, 6) place approximately 750 sq. ft. of shotcrete below the dam and beneath the driveway bridge, 7) replace the existing fountain at the Upper Pond, 8) replace the existing gabion wall and the existing brick retaining walls, and 9) redirect an existing drainage pipe and install additional drainage behind the existing masonry walls.
A temporary bypass of 70 feet in stream length for the diversion weir and a temporary construction entrance of 12 feet in stream length over the drainage area will also be constructed.

The applicant proposes to treat approximately 6 acres of a 10.5 acre pond with the aquatic herbicide Aquathol-K (active ingredient: dipotassium salt of endothall) and the algaecide copper sulfate. In addition four smaller golf course ponds totalling approximately 0.86 acres will be treated with the aquatic herbicide Sonar AS (active ingredient: fluridone) and the algaecide copper sulfate. The ponds are located on the Town of Wallkill Golf Club located on Sands Road. The proposed treatments are for the control of nuisance aquatic vegetation (Ceratophyllum spp., Potamogeton natans, Lemna sp., Najas sp.) and filamentous algae. Portions of the ponds are also mapped as State-designated Freshwater Wetland No. WU-16. Permits have been in place for these activites through the last ten years. Re-issuance of these permits would not change the previously authorized activities.

The applicant proposes to reconstruct the "Stump Pond" dam, located on the west side of Stump Pond Road, approximately one mile northwest of the intersection with Sullivan County Route 149 (Shandelee Road). The dam would be reconstructed as an earth fill dam approximately 250 feet long with a primary concrete spillway and an auxiliary (emergency) spillway. The dam would be approximately 15-1/2 feet high. The normal lake elevation in existence prior to the past dam failure will not increase as a result of the dam reconstruction.

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 003-4002, DEC Identification #: 3-5156-00024-00002), the Village of Ellenville STP Facility pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:
Mass limits for CBOD5, UOD and TSS were rounded to 2 significant figures in compliance with NYSDEC guidance.
Copper has been changed from an action level of 1.5 lbs/day to a new more stringent water quality limit of 0.7 lbs/day. The limited parameter for cyanide, amenable to chlorination found in the old permit has been changed to free cyanide and has also been changed from a limit of 0.4 lbs/day to a new more stringent water quality limit of 0.16 lbs/day.
The current permit contains a water quality based effluent limit for chromium, of 6.0 lbs/day. The water quality standard for chromium has been revised upward since that water quality limit was calculated. Calculation of the current water quality limit resulted in a value of 13.3 lbs/day. The permittee discharges less than 6.0 lbs/day. Thus, the draft permit continues to monitor the discharge of chromium as an action level of 6.0 lbs/day. The action level for zinc has changed from 9.4 lbs/day to 3.0 lbs/day.
EPA Method 1631, has now been approved by EPA and is required in the compliance schedule of this draft permit. In addition, the Dental Amalgam Rule was recently passed, that requires dentists to capture and recycle mercury used in amalgam (for fillings). The equipment used to capture the mercury containing material must be installed within two years and notification sent to their local wastewater treatment plant.
The modification also includes several other minor reporting modifications. The Village of Ellenville STP has surface discharge into Sandburg Creek, a class B(T) water. NYSDEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
