The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the New York State Department of Environmental Conservation Law (ECL) and made a tentative determination to approve this permit for the construction and operation of the applicant? s scrap metal processing facility. The sources subject to the State Facility Permit requirements consist of three secondary smelting furnaces for scrap aluminum and copper recovery. The draft permit and application are available for public review at the Region One office. The draft Air State Facility permit includes conditions to construct and operate the scrap metal processing facility based on 6NYCRR Part 201, 6NYCRR Part 202, 6NYCRR Part 211, 6NYCRR Part 212 and 40CFR 61M and 63RRR. When overlap, the permit contains the most stringent limits, which includes emission limits, monitoring conditions and record keeping requirements.
