Project Description:
The Department has made a tentative determination to approve an application for a Title V Renewal. The facility provides heating, cooling, hot water and electricity to a residential apartment complex. The facility operates two dual fuel boilers, two dual fuel chillers/heaters, and six diesel engine generators. The facility has applied for a variance due to economic and technological reasons for an alternate NOx emission limit of 6.0 gr/bhp-hr for the six existing diesel engines/generators. This variance was granted by DEC pending EPA's final approval. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.
An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist. The Department has made a tentative determination to approve application renewals (Title V and Title IV) for an existing facility. This Power Station consists of one 100 MW turbine/generator boiler operating on pipeline natural gas, #1, #2 and #6 fuel oils. This boiler has the ability to burn waste oil generated on site for energy recovery. In addition, an industrial steam boiler is maintained on site for heating the building. The facility wide emissions for major air pollutants exceed the major pollutants thresholds and is subject to the provisions of Title V specified under 6NYCRR Subpart 201-6.
The Title IV (Phase II Acid Rain) under Article 19: SO2 Allowances from Table 2 of 40 CFR 73: Unit 40, 2000-09 allowance, 469; allowance 2010 and thereafter is 470. (40 CFR Part 75 does not apply to this facility).

Project Description:
The applicant proposes to eliminate the continuing deterioration of the shoreline and to provide adequate draft for bulk carriers bringing salt to the facility.The proposed project includes installation of a new sheet pile bulkhead with tie back system and shore protection to stabilize the shoreline and dredging to a depth of 47 feet below mean low water plus 2 feet over depth.
An approximately 1000 foot bulkhead is proposed to stabilize the shoreline, prevent further erosion or collapse of the existing waterfront structures and ensure a stable area for unloading and stockpiling the salt. An 8 foot roadway is proposed between the bulkhead and the salt containment wall to allow access for vehicles to remove any accidental spillages of salt. Upland areas disturbed during construction will be regraded and filled with clean fill as required by NYSDEC.
Upper sediments removed during dredging will be processed and beneficially reused at an upland placement site and underlying sediments are being tested for their suitability for placement at the Historic Area Remediation Site.
The project site is located at 561 Richmond Terrace, Staten Island.
