The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above. NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below. NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Monroe County - The State University Construction Fund, as lead agency, has determined that the proposed abate asbestos/remove equipment/refinish heating plant, building 34 will not have a significant adverse environmental impact. In 1992, the building was decommissioned by the campus and replaced with satellite boilers through the campus buildings. The project goals will be met by rehab of the building, including removal of all heating plant equipment, abatement of all hazardous materials and the performance of critical maintenance and renovations to remain (reproofing, code-compliant fire protection sprinkler system, window and door replacement). The project is located on the existing campus of the State University College at Brockport, Brockport, Monroe County, NY.

Monroe County - The Director of Zoning, as lead agency, has determined that the proposed Metalico Rochester, Inc.will not have a significant adverse environmental impact. The action involves expanding an existing junk yard by adding an autoprocessing (fluids extraction) and dismantling operation.. The project is located at 42 Portland Avenue, Rochester, NY.

Monroe County - The Director of Zoning, as lead agency, has determined that the proposed Damico Wrecking Co., Inc. will not have a significant adverse environmental impact. The action involves establishing a scrap metal processing facility and storage yard, a junkyard operation.. The project is located at 255 and 295 Mc Kee Road, Rochster, NY.

Monroe County - The Webster Planning Board, as lead agency, has determined that the proposed Continuing Developmental Services (CDS) will not have a significant adverse environmental impact. The CDS project is located east of 858 Hard Road, in the Town of Webster. The overall parent parcel consists of a proposed subdivision/combination of a total of approximately 18.0 acres, including a 300.0 foot access road and Hard Road street improvements, ten acres to be occupied by the CDS development, and approximately 8 acres south of the proposed CDS parcel remaining undeveloped. The overall site plan is being considered for both final Site Plan and Subdivision Approval. The project consists of the development of an approximately 60,000 square foot building facility containing 28,000 square feet of office space, 18,000 square feet of classrooms space, and an assembly and shipping area of 17,000 square feet. The proposed development will also require the granting of a storm water easement of approximately 0.8 acres and physical alterations to create a storm water facility for this project site. In that the overall physical disturbance associated with the proposed project may affect approximately 8.0 acres, the project has been deemed a Type 1 action by the lead agency, the Town of Webster Planning Board. The project is located approximately 150 feet north of the northeast corner of Hard Road and Route 104, Webster, New York, having parcel numbers 079.11-1-2.1 and 079.11-1-9.

Orleans County - The Town of Murray, as lead agency, has determined that the proposed Local Law No. 3 of 2007 - Regulating Wind Energy Facilities will not have a significant adverse environmental impact. The local law establishes regulations for commercial wind energy facilities, small wind energy facilities, meteorological towers and agricultural wind energy facilities. The local law also includes finding statements, word definitions, permit application procedures, permit renewal procedures and enforcement procedures. The local law also establishes standards for each type of wind energy facility and authorizes the town to enter into host agreements. The project is located in the Town of Murray, Orleans County, NY.
