The Department has received an application from David Seweryniak for yard area modifications at an existing children's day care facility, within in the 100 foot adjacent area of Class 2 Freshwater Wetland BS-5. The applicant proposes excavation, fill, grading, and drain tile installation on a 0.687 acre property to improve a playground surface and expand a parking area.

The Department has tentatively determined that a permit can be issued for the project as proposed, provided that comments received do not raise significant issues that have not been addressed. The application is available for review at the Region 8 NYSDEC office.

Filed application documents, and Department draft permits where applicable, are available for inspection under the provisions of the Freedom of Information Law during normal business hours at the address of the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Project Description:

Applicant proposes to construct 32 single family residential homes on a 44.484 acre parcel at 310 Aldrich Road in the Town of Perinton. The subdivision, referred to as Aldrich Glen Subdivision, will involve the construction of a 1.2 acre stormwater management facility partially within the 100 ft. adjacent area of NYS Freshwater Wetland PR-2(I). The project sponsor proposes to donate 26.11 acres of wetland and associated adjacent area, along with the proposed stormwater management pond, to the Town of Perinton. The pond will also serve an older development which currently discharges to the wetland/stream complex.

No further review in accordance with SHPA is required.
