Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the Applicant's facility located in Stony Point, New York. The United States Gypsum company operates a gypsum wallboard manufacturing facility. This facility consists of two gypsum board lines, gypsum ore mill operation, packing, specialty and product warehouse. The facility is currently permitted to operate four kettles. Rushed and sized gypsum rock is calcined in these kettles to create stucco. This renewal includes the replacement of Kettle #2 (Emission Unit UOOOK2) with two new high energy efficient kettles, designated kettles #2 North and # 2 South and will remain under the same emission unit.

All other air contamination sources located in this facility remain the same.

Applicable regulations include 6NYCRR Parts 200, 201-1, 201-3, 201-6, 202, 215, 225, 227, 40 CFR 60, and 40 CFR 82 F.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.state.ny.us/website/dar/boss/afs/index.html. Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within two (2) business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law. Project Description:

The Department of Environmental Conservation has tentatively determined to issue a draft modification of the State Pollutant Discharge Elimination System (SPDES) permit held by the Town of Fallsburgh for discharge from the Mountaindale Wastewater Treatment Plant (WWTP.) This modification was initiated by the permittee and encompasses an upgrade/expansion of the plant's discharge capacity from 180,000 Gallons Per Day (GPD) of sanitary wastewater to 220,000 GPD. The upgrade is for the purpose of accommodating sewage from the Mountaindale Estates Subdivision. The receiving water is Sanbburg Creek, Class B(T). Effluent limitations and monitoring requirements (to include temperature limits) are included in the draft permit. SPDES NY 014 5696.

The Department has made a tentative determination to approve this application for a SPDES permit to discharge a maximum volume of 30,000 gallons per day of treated sanitary wastewater from a proposed sewage treatment plant into an unnamed tributary of Sheldrake Stream (DEC Water Index No. D-1-38-7a; Class C). The proposed plant will be located approximately 1,100 feet west of Murphy Road, about 0.6 mile south of the intersection with NYS Route 52. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits. A draft SPDES permit (SPDES No. NY-0271063) is available for review the NYSDEC Region 3 office.

The project also involves the extension of the Town of Fallsburg Consolidated Water District to serve the site. A separate application for a Public Water Supply permit has been filed with the Department by the Town of Fallsburg. A stormwater pollution prevention plan has been prepared for the project pursuant to the SPDES General Permit for Stormwater Discharges from Construction Activities (GP-02-01).
