DEPARTMENT OF ENVIRONMENTAL CONSERVATION
SUPPLEMENTAL NOTICE
Applicant: New York City Department of Sanitation ("DOS"), 125 Worth Street, New York, New York 10013 (Application No. 2-6105-00666/00001).
Project: The applicant proposes to operate a yard waste composting facility at 12720-B Flatlands Avenue, Brooklyn, southeast of the intersection of Fountain and Flatlands Avenues, Brooklyn. The proposed project, applicable requirements and the review process are further described in a Notice of Complete Application that was published in the Daily News on December 27, 2002 and in a Notice of Hearing that was published in the Daily News on February 17, 2004. These notices were published in the Department of Environmental Conservation's ("DEC's") Environmental Notice Bulletin on December 25, 2002, and February 18, 2004, respectively. Copies of these notices may be obtained from the DEC Office of Hearings and Mediation Services, 625 Broadway, 1st Floor, Albany, New York 12233-1550 (Attn: Susan J. DuBois, Administrative Law Judge), telephone 518-402-9003.
Permits: Solid Waste Management permit pursuant to the New York State Environmental Conservation Law ("ECL") article 27, title 7 and part 360 of title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York ("6 NYCRR part 360"), subpart 360-5 (Composting and Other Class A Organic Waste Processing Facilities). The Applicant also requested three variances from the provisions of 6 NYCRR 360-5.5(g) and 360-4.4(d), with regard to distances from the perimeter of the site to the property line, surface waters, and places of business and residences. Part 360 of 6 NYCRR was amended in early 2003 and the amended provisions regarding distances from these features are found at 6 NYCRR 360-5.7(b)(7).
