PROJECT LOCATION: 1 LILCO Road, Shoreham, NY 11786

PROJECT DESCRIPTION: The Long Island Power Authority (LIPA) proposes to lease, install and operate twenty four trailer-mounted Cummins Power Generation Mobile Generation Units (MGUs) and ancillary equipment (fuel supply tanks, emission control equipment, transformers, etc.) on 3 acres of the 50 acre parcel owned by LIPA adjacent to the former Shoreham Nuclear plant. The MGUs will supply temporary power to the LIPA distribution grid to avoid voltage reductions and/or power blackouts. They are intended to be used during the peak demand season and will be restricted to operate between date of permit issuance and October 31 of this year, and between May 1 and October 31 of any subsequent year during the remainder of the permit term. Daily use will be restricted to the hours between 12:00 noon and 8:00 PM.

Each of the MGUs has a rated maximum output of 1.825 megawatts (MW) of electricity, and the maximum electrical output of the facility consisting of the twenty four units together is 43.8 MW. Each MGU consists of a system of two trailers: one 40 foot trailer for generation, and one 40 foot trailer for pollution control equipment modules (SCR, oxidation catalyst and a particulate trap for 18 of the 24 units). The generation trailer houses the 2,150 gallon oil tank, and the Pollution Control trailer houses the 700 gallon urea storage tank. Treated exhaust gas would be emitted through a 28.5 foot stack on units with a particulate trap and a 45 foot stack on units without a particulate trap. The MGUs have no water demand and will generate no wastewater discharge.

The MGUs will be fueled by ultra low sulphur (0.003% or less) distillate oil. All units will be equipped with Selective Catalytic Reduction (SCR) to control formation of nitrogen oxides (NOx) and associated emissions, and an oxidation catalyst system to reduce emissions of carbon monoxide (CO) and volatile organic compounds (VOCs). Particulate traps will be installed on 18 of the MGUs to reduce emissions of particulate matter (PM), and these units must be operating before a unit without a particulate trap can be brought into use. Total emissions of NOx from this facility will be less than 22.5 tons per year.

The Department has made a tentative determination to approve this application. PERMITS: LIPA has applied for an air pollution control permit pursuant to Article 19 of the Environmental Conservation Law ("ECL") and Part 201 of Title 6 of the New York Compilation of Codes, Rules and Regulations ("6NYCRR"). DEC has tentatively determined that the application meets all air pollution control requirements of Article 19, and Part 201.

SEQR STATUS: Pursuant to the State Environmental Quality Review Act ("SEQR", ECL Article 8 and 6 NYCRR Part 617), Long Island Power Authority (LIPA), as lead agency, has determined that the project will not result in significant adverse environmental impact. LIPA issued a Negative Declaration on March 24, 2004.

STATE HISTORIC PRESERVATION ACT (SHPA) DETERMINATION: A cultural Resources survey has been completed. The report of the survey is on file. No archeological sites or historic resources were identified at the project location. No further review in accordance with SHPA is required.

COASTAL ZONE MANAGEMENT: This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

PUBLIC HEARING: A legislative hearing session for the receipt of public comments, on the application will be held at 7:00 PM on May 5, 2004 at the following location:

All persons, organizations, corporations, or government agencies who may be affected by the proposed project are invited to attend the hearing and to submit oral or written comments on the application. It is not necessary to file in advance to speak at the hearing. Lengthy comments should be submitted in writing. Equal weight will be given to both oral and written statements. The Administrative Law Judge ("ALJ") may limit the time available for oral comments to 5 minutes per person to ensure that all persons have an opportunity to be heard. The hearing facility is reasonably accessible to the mobility impaired.

WRITTEN COMMENTS: Parties may file written comments with the NYS DEC Division of Environmental Permits, Department of Environmental Conservation, 625 Broadway, Albany, New York 12233-1750, attn: Kevin Kispert, Project Manager. Written comments must be received at this address no later than May 14, 2004.

DOCUMENT AVAILABILITY: The Department has reviewed the application materials, determined that they are complete pursuant to 6NYCRR Parts 201 and 621, made a tentative determination to approve the application and has prepared a draft permit. It has been determined that all statutory and regulatory criteria can be met through the imposition of special permit conditions.
