ANNOUNCEMENT OF PUBLIC COMMENT PERIOD, and
COMBINED NOTICE OF COMPLETE APPLICATION and
LEGISLATIVE PUBLIC HEARING

PROJECT LOCATION:Port Jefferson Energy Center, Beach Street, Port Jefferson NY 11777

PROJECT DESCRIPTION: Keyspan Energy Development Corp. ("Keyspan") proposes to construct and operate a new gas turbine facility, Port Jefferson Energy Center. The new facility will be constructed immediately adjacent to the existing Port Jefferson Power station. The proposed Port Jefferson Energy Center (Project) will consist of two General Electric (GE) LM6000 Sprint simple cycle combustion turbines. The total new electrical power from these two combustion turbine generators will be limited to a net output of 79.9 MW to the electric grid. The Port Jefferson Power Plant is an existing major source; the proposed Project will be considered a minor modification to this source as maximum emissions of all criteria pollutants will be below Prevention of Significant Deterioration (PSD) significant increase thresholds and Non-Attainment New Source Review (NNSR) significant net increase thresholds.

The combustion turbines will fire natural gas as the primary fuel with limited hours of low sulfur distillate oil firing as a back-up during times of natural gas curtailment. The units will operate in simple cycle mode (no heat recovery) to provide electric generation particularly during periods of high demand. The turbines will utilize water injection and selective catalytic reduction (SCR) to control nitrogen oxide (NOx) emissions. Upon leaving the turbines, the exhaust will be directed into a common 265-foot stack with two separate 10-foot diameter flues.

PERMITS

AIR: Keyspan has applied for an air pollution control permit pursuant to Article 19 of the Environmental Conservation Law ("ECL") and Part 201 of Title 6 of the New York Compilation of Codes, Rules and Regulations ("6 NYCRR"). DEC has tentatively determined that the application meets all air pollution control requirements of Article 19 and Part 201.

State Pollutant Discharge Elimination System (SPDES): The existing facility, Port Jefferson Power Station, has applied for a modification of their existing SPDES permit (SPDES Permit No. 000 5932) to accommodate the additional process water and stormwater from the new facility. This additional wastewater will be discharged through the existing outfalls.

SEQRA STATUS: Pursuant to the State Environmental Quality Review Act ("SEQRA"), ECL Article 8 and 6 NYCRR Part 617), Long Island Power Authority (LIPA), which served as lead agency, has determined that the project will not result in any significant adverse environmental impacts. The project is a Type I action under SEQRA. LIPA issued a Negative Declaration on November 13, 2001.

PUBLIC HEARING: A legislative hearing for the receipt of public comments on the application will be held, beginning at 2:45 p.m. on December 7, 2001 at the following location:

All persons, organizations, corporations, or government agencies who may be affected by the proposed project are invited to attend the hearing and to submit oral or written comments on the application. It is not necessary to file in advance to speak at the hearing. Lengthy comments should be submitted in writing. Equal weight will be given to both oral and written statements. The Administrative Law Judge ("ALJ") may limit the time available for oral comments to 5 minutes per person to ensure that all persons have an opportunity to be heard. The hearing facility is reasonably accessible to the mobility impaired.

WRITTEN COMMENTS: Parties may file written comments with the NYS DEC Division of Environmental Permits, Department of Environmental Conservation, 625 Broadway, 4th Floor, Albany, New York 12233-1750, attn: Christopher M. Hogan, Project Manager. Written comments must be postmarked no later than December 14, 2001.

DOCUMENT AVAILABILITY: The Department has reviewed the application materials, determined that they are complete pursuant to 6 NYCRR Parts 201, 750 and 621, made a tentative determination to approve the application and has prepared a draft permits. It has been determined that all statutory and regulatory criteria can be met through the imposition of special permit conditions. The application materials, as well as a draft air and SPDES permits, are available for review during normal business hours, Monday through Friday, at the following locations:

STATUTORY and REGULATORY PROVISIONS: The air and water permit application is applications are being reviewed pursuant to ECL Article 19 (Air Pollution Control) and 6 NYCRR Part 201 (General Provisions - Air Pollution Control); ECL Article 17 (Water Pollution Control) and 6 NYCRR Part 750 (SPDES); Part 617 (SEQR); Part 621 (Uniform Procedures); and Part 624 (Permit Hearing Procedures).
