Palumbo Block Company (Supplemental)

July 11, 2000

STATE OF NEW YORK
DEPARTMENT OF ENVIRONMENTAL CONSERVATION
SUPPLEMENTAL NOTICE

APPLICANT: PALUMBO BLOCK COMPANY, Dover Furnace Road, P.O. Box 810, Dover Plains, New York 12522 (DEC Application No. 4-1020-00035/00001)

PROJECT: The Applicant proposes the surface mining of unconsolidated sand and gravel at a site located on the east side of NYS Route 22 approximately 1 mile north of White House Road in the town of Ancram, Columbia County. This project was the subject of a notice of hearing which was published in the Independent on June 21, 1999 and in the DEC's Environmental Notice Bulletin on June 23, 1999. A public hearing on the application for a Mined Land Reclamation permit began on July 20, 1999.

The present notice is being published due to new information regarding the location of the land on which the Applicant has an option to purchase, and which the Applicant is taking into account in proposing setback distances. The June, 1999 notice described the site as being located only in the Town of Ancram, Columbia County, based on information in the Draft Environmental Impact Statement ("DEIS"). In correspondence after the beginning of the hearing, the Applicant's consultant identified the land as also including an area in the Town of Northeast, Dutchess County, contiguous with the land which was identified in the DEIS.

No mining is proposed to take place on the land which is located in the Town of Northeast. The Applicant might want to grow trees on the land in the Town of Northeast but is not proposing this as part of the mining application.

PUBLIC COMMENTS: A comment period on the application and the DEIS was provided in June and July, 1999. Any addition comments regarding the new information may be provided on or before August 10, 2000, addressed to: Susan J. DuBois, Administrative Law Judge, DEC Office of Hearings and Mediation Services, 50 Wolf Road, Albany, New York 12233-1550. Copies of any such comments must be sent to counsel for the parties at the following addresses: Laura Zeisel, Esq., 169 Main Street, P.O. Box 9, New Paltz, New York 12561; Richard Ostrov, Esq., NYS DEC Region 4, 1150 North Westcott Road, Schenectady, New York 12306-2014; and Warren Replansky, Esq., Osofsky and Replansky, P.O. Box 659, Pine Plains, New York 12567.

For further information please see the original notice of hearing or contact the DEC Office of Hearings and Mediation Services at 518-457-3468, Attn.: Susan DuBois.
