SUPPLEMENTAL NOTICE OF COMPLETE APPLICATION AND PUBLIC HEARING
PUBLISHED IN THE ENVIRONMENTAL NOTICE BULLETIN ON OCTOBER 2, 2001 AND
IN THE MIDDLETOWN TIMES HERALD RECORD ON OCTOBER 4, 2001.
SUPPLEMENT: This supplemental notice provides that the applicant has applied for a protection of waters permit pursuant to Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, Part 608 and Environmental Conservation Law ("ECL") Article 15. All other statutory and regulatory citations in the prior public notice dated October 2, 2001 remain the same. The project description has not changed.

PUBLIC HEARING AND ISSUES CONFERENCE: A prior public hearing was held on October 30, 2001 to allow comment on the record regarding the proposed project. Written comments regarding the 6 NYCRR Part 608 permit as noted above will be received until November 29, 2001 and must be sent to the following address: NYS DEC Office of Hearings and Mediation Services, Attention Molly T. McBride, Administrative Law Judge, 625 Broadway, Albany, New York 12233-1550 by that date. A pre-adjudicatory issues conference will commence on November 13, 2001 with regards to the original notice published herein. A supplemental issues conference will be held on December 3, 2001 at 10:00am at Montgomery Town Government Center, 2nd floor meeting room, located at 110 Bracken Road, Montgomery, New York 12549 (845) 457-2660 to address any additional party petition filings received regarding the 6 NYCRR Part 608 permit. This supplemental issues conference will be cancelled if no petitions are filed.
All Petitions requesting party status with regards to the 6 NYCRR PART 608 permit seeking to participate at the adjudicatory hearing must be received at the Office of Hearings and Mediation Services no later than the close of business on November 29, 2001. Such filings should be submitted to Molly T. McBride Administrative Law Judge New York State Department of Environmental Conservation Office of Hearings and Mediation Services 625 Broadway, First Floor, Albany, New York 12233-1550; Telephone number (518) 402-9003. FILINGS BY TELECOPIER TRANSMISSION WILL NOT BE ACCEPTED. At the same time, all petitioners must also send a copy of their complete filing to David Capobianco of the NYSTA at the address given above and Margaret E. Duke, Region 3 Regional Permit Administrator, NYS Department of Environmental Conservation, Division of Environmental Permits, 21 South Putt Corners Road, New Paltz, NY 12561.
