HENRY G. AND ROBERT G. MILLER

This is Notice of Cancellation of the public hearing in the matter of the application of Henry G. and Robert G. Miller for a well drilling permit and a variance to the well spacing requirements with respect to the proposed well, Miller Fee No. 1 in the Town of Perrysburg, Cattaraugus County.
As cited in the original Notice of Public Comment Period and Public Hearing, pursuant to Environmental Conservation Law Section 23-0501(3), if no substantive and significant comments regarding the proposed Project are received and there are no facts in dispute, the hearing may be canceled and the Department may grant the well drilling permit and the well spacing variance. In this case, no comments were received during the comment period. Therefore, the public hearing scheduled to be held in the Perrysburg Volunteer Fire Hall in the Town of Perrysburg, New York at 1:30 P.M. on Wednesday, May 24, 2000 is canceled, and the Department will issue an Order to formally grant the well drilling permit and the well spacing variance sought by the applicants.
