SUPPLEMENTAL NOTICE OF COMPLETE APPLICATION AND
NOTICE OF PUBLIC HEARING
DEC Project #5-5338-0009/00001
This is a supplemental notice pertaining to applications submitted by Jointa Galusha L.L.C, (Jointa), 209 Warren Street, P.O. Box 536, Glens Falls, NY 12801 for permits associated with its proposal (DEC Project #5-5338-00009/00001) to substantially expand mining operations to include a 190 acre rock quarrying site on a 1300 acre parcel of land located entirely within the Town of Hartford, Washington County. This notice supplements earlier notices that appeared in the Environmental Notice Bulletin on November 29, 2000 and January 24, 2001 and in The Glens Falls Post Star newspaper on December 4, 2000 and January 25, 2001.
When the project was first noticed by NYSDEC on November 29, 2000, the PERMITS section of the notice stated that the project would require a Freshwater Wetlands permit "for the construction of a portion of the (mine) access road". Subsequent to the November, 2000 notice, it was determined that construction of the mine access road would not involve a New York State Freshwater Wetland and, therefore, a Freshwater Wetlands permit would not be required. Thereafter, at the request of the Town of Hartford, NYSDEC extended the deadline for public comment on the application from January 31, 2001 to March 2, 2001. The determination to extend the public comment period required publication of a revised notice. DEC staff took this opportunity to publish a revised notice that extended the comment deadline and excluded the reference to Freshwater Wetlands permits from the PERMITS section of the notice. This revised notice was published in late January, 2001 as noted above. However, subsequent to publication of the revised notice, it was determined that the wetlands mitigation project proposed by the applicant to mitigate impacts to federal wetlands would, in fact, require a New York State Freshwater Wetlands permit. The wetland mitigation project is described in the draft environmental impact statement that was accepted as complete on November 22, 2000. The wetland mitigation project involves freshwater wetland FA-1, a class III wetland located near the north boundary of the project. By itself, the wetland mitigation project is a minor activity pursuant to the Department's Uniform Procedures regulations (6NYCRR Part 621).
