Supplemental Legislative Hearing
DEPARTMENT OF ENVIRONMENTAL CONSERVATION
ANNOUNCEMENT OF SECOND SESSION OF PUBLIC HEARING
HEARING PURPOSE AND LOCATION
The New York State Department of Environmental Conservation (DEC) announces the second session of a public hearing on the New York Power Authority's (NYPA) applications for permits for two existing power plants located in the South Bronx. The permits are federally-required operating permits known as "Title V" permits. A first session was held on September 10, 2003. The second session will be held September 24, 2003 at 7:00 PM at the following location:

THE POWER PLANTS
Comments will be received on NYPA's Title V applications for two existing facilities:
The Hell Gate Plant, located at Locust Avenue, E. 132nd St. to E.
134th St., Bronx, NY. [DEC No. 2-2-6007-00724/00003]
The Harlem River Yard Plant, located in the Harlem River Yards, at E.
132nd Street, Bronx, NY. [DEC No. 2-6007-00726/00003]
BRIEF BACKGROUND
DEC issued NYPA approvals known as State Facility permits for these plants in January 2001. NYPA constructed and began operating the facilities in July and August 2001. Federal regulations required NYPA to apply for Title V permits within the first year of commercial operation; NYPA applied for the permits in July 2002.
The Department has determined that the applications are complete. DEC has prepared draft Title V permits for the plants. The draft permits require conformity with all applicable State air pollution regulations and all Federal requirements for enforceable permit conditions.

HOW TO COMMENT
At the hearing you may speak or provide written comments on the Title V applications and draft permits. DEC will consider all comments in making its decision on the Title V permits.

PREVIOUS PUBLIC NOTICE
Notices of the applications, draft permits and the first hearing session were published in a Combined Notice of Complete Application and Legislative Public Hearing for each project. The notices and hearing announcements were published in The New York Times, El Diario (in Spanish), The Daily News, The Riverdale Press, The Bronx Times Reporter, and Hoy (in Spanish). The notices were posted in the July 16, 2003 Environmental Notice Bulletin, an online publication of the Department.
