This notice is issued pursuant to 6 NYCRR Parts 617 and 621 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) and Article 70 (Uniform Procedures) of the Environmental Conservation Law.

The New York State Department of Environmental Conservation has determined that a Legislative Hearing will be held to receive additional comment on this application and dEIS. The Hearing will be conducted pursuant to 6NYCRR Parts 617 and 621. The Legislative Hearing will be held at 7:00 P.M. on the 27th of March 2001 at the Holiday Inn, 304 South Hamilton Street, Painted Post, New York.

Name of Action: Scudder Sand and Gravel Pit, Smith Hill Road

Applicant: Dalrymple Gravel and Contracting Company, Inc., 2105 South Broadway, Pine City, New York 14871

SEQR Status: Type I

Description of Action: The applicant, Dalrymple Gravel and Contracting Company, Inc., proposes to develop a 112 acre sand and gravel mine on a 313 acre parcel in the Town of Erwin, Steuben County. The mine will operate as a traditional surface excavation of sand and gravel by mechanical equipment standard for this type of mine. Mining will occur below the water table utilizing a dragline. The excavated material will be washed, screened and crushed. Wash water will be directed to settling ponds and recirculated for reuse: no surface water discharges are proposed. Process dust will be managed by a wet spray system and haulage areas will be patrolled by a water truck. Final reclamation will restore the site to an open water recreational pond. Upland reclamation will include replacement of stockpiled topsoil and reseeding with an approved USDA SCS seed mixture to stabilize banks. Unaffected land will remain agriculture or forested.

Location: The proposed mining site is bounded on the north by Smith Hill Road, the east by the Cohocton River, and the south and west by a very steep wooded hillside.

Project Review: Pursuant to SEQR, the Region 8 Department Staff, as Lead Agency, issued a Positive Declaration for this Type I action on 28 July 2000. The applicant prepared a draft Environmental Impact Statement (dEIS). Department Staff issued a Notice of Complete Application and availability of the dEIS on 19 December 2000.

The Legislative Hearing will be held to receive unsworn statements from the public about the applicant's proposal and the dEIS. All comments filed in response to the Department's Notice of Complete Application and Acceptance of the dEIS issued on 19 December are a part of the record for this proceeding. If you have commented on the dEIS or application previously, you do not need to resubmit your comments for the purpose of this Hearing.

Written comments on the dEIS will be accepted until 10 days after the close of the Hearing. No filing is required to speak at the Hearing. The hearing location is reasonably accessible to persons with a mobility impairment. Interpreter services may be available to deaf persons at no charge. Requests for an interpreter must be made to the contact person at least 10 business days before the hearing.

The dEIS and other project information are available for your review at the Regional Office of NYS DEC on 6274 East Avon-Lima Road in Avon, NY. Copies of the application and dEIS are also available at the Town of Erwin Town Hall and the Southeast Steuben County Library, 300 Civic Center Plaza, Corning.

This is the same hearing previously noticed in the "SEQR and Other Notices" sections of the February 28 and March 7, 2001, issues of the ENB.

The application was filed and is being reviewed pursuant to ECL Article 3, Title 3 (General Functions), Article 8 (State Environmental Quality Review), Article 19 (Air Pollution Control), 6 NYCRR Parts 200 (General Provisions) and 201 (Permits and Registrations), Article 23 (Minerals Resources), 6 NYCRR Part 420 (Mined Land Reclamation), Article 70 (Uniform Procedures Act), and Part 621 (Uniform Procedures).
