Project Description: The action involves the construction and operation of a 31.9 acre construction and demolition debris (C&D) landfill with storm water management, landfill gas collection and leachate collection systems, yard waste composting, recycling operations, and excavation and landfilling of the existing closed 3 acre C&D landfill.

Public Hearing and Written Comment Period: Notice is hereby given that a Legislative Public Comment Hearing regarding this proposed project is scheduled for Wednesday, February 7, 2018 at the Frewsburg Middle School/High School Auditorium, located at 26 Institute Street, Frewsburg, NY, starting at 6:00 p.m. to receive unsworn statements from the public. The hearing will be rescheduled to Thursday February 8, 2018 in the event that the Frewsburg School District closes school for the day or closes early due to weather. If the hearing is rescheduled, it will be held at the same location at 6:00 p.m. Written comments may also be submitted. All persons, organizations, corporations or government agencies which may be affected by the proposed project are invited to comment on the applications. The Administrative Law Judge (ALJ) may limit the time available for oral comments to ensure that all persons have an opportunity to be heard.

All persons having an interest in this project are urged to attend or be represented either individually or collectively. It is not necessary to file a written request in advance to speak at the legislative hearing. Written statements and comments on the application are encouraged, and any statements and comments may be filed prior to, or at the hearing, but no later than the deadline for written comments, which is Monday, February 12, 2018. Written comments must be submitted to the attention of: Charles Cranston, NYSDEC Division of Environmental Permits, 182 East Union, Suite 3, Allegany, New York 14706-1328.

This hearing location is reasonably accessible to persons with a mobility impairment. Translator services shall be made available, at no charge, upon written request to the ALJ. All requests must be made to the NYSDEC Office of Hearings and Mediation Services, ALJ Molly T. McBride, 625 Broadway, First Floor, Albany, New York, 12233-1550, Phone: (518) 402-9003. The request must be received no later than 4:00 p.m. on February 1, 2018.

Following the hearing, NYS DEC will make a determination on whether substantive or significant issues have been raised as defined in 6 NYCRR Part 621 Uniform Procedures, and if an Adjudicatory Public Hearing should be scheduled before an Administrative Law Judge. In order to raise substantive and significant issues, written comments expressing objections to or opposition to the application must explain the basis of that opposition and identify the specific grounds which could lead the Department to deny or impose significant permit conditions on the project.
