MPM Silicones, L.L.C. - Hazardous Waste Management Permit Renewal

On April 2, 2015 NYSDEC issued MPM Silicones, LLC's (MPM) a renewal permit. NYSDEC's prepared a responsiveness summary to MPM's comments on the draft renewal permit. As allowed by DEC's Permit Hearing Procedures regulation on May 1, 2015, MPM requested an issues conference and adjudicatory hearing on the permit. A Public Statement Hearing and Public Issue Conference was held on August 25, 2015, with statements only being provided by the applicant MPM and by NYSDEC staff. Subsequent to the hearing, only the Applicant MPM and the NYSDEC remained parties to the May 1 hearing request. Subsequent to the hearing request and Public Issues Conference, the parties have resolved all outstanding issues contained in the May 1, 2015 hearing request prior to commencing an adjudicatory hearing. The Department has drafted a revised permit based on the resolved issues.

Tentative Determination

Subsequent to the hearing negotiations, all issues brought forth by MPM regarding the permit issued on April 2, 2015, within their May 1, 2015 hearing request have been resolved. The NYSDEC has determined that the MPM permit application is complete and has made a determination to issue the permit renewal. The revised draft permit has been prepared pursuant to the applicable regulations in 6NYCRR Part 373-2 (Final Status Standards for Owners and Operators of Hazardous Waste Treatment, Storage and Disposal Facilities) as well as with all other applicable hazardous waste management laws and regulations.
