Public Comment on Delisting of Registry Sites
In accordance with the Environmental Conservation Law (ECL §27-1305), the DEC maintains the "Registry of Inactive Hazardous Waste Disposal Sites" (Registry). When a site qualifies for placement on the Registry, it is given a classification between one and five that indicates its relative priority and progress towards cleanup. As the remediation of the site progresses, its classification changes (e.g., from Class 2 (site presents a significant threat to public health or the environment) to Class 4 (site properly closed but requires continued management)). A site may be "delisted" from the Registry when the DEC, in cooperation with the New York State Department of Health, has determined that all remediation and post-remediation activities have been satisfactorily completed. The DEC notifies the public when sites are initially placed on the Registry, during the remediation process, and when the site qualifies for delisting.
Public Comment Period
After determining that a site qualifies for delisting, the DEC announces a public comment period (30 days) by issuing a notice in a local newspaper and the DEC's Environmental Notice Bulletin.

All comments must contain a reference to the site by site name and ID number. A summary of responses to the comments will be made available to the public in the DEC Regional Office or a site document Repository for the site (often a local library).
