Solid Waste Facilities Forms

2012 Annual Report is due no later than March 4, 2013, in accordance with 6 NYCRR Part 360.

Please note that several of the reports have changed this year, requesting information that is different or in a different format than previous years. DO NOT use previous years' forms! You are responsible for completing and submitting the appropriate forms for all of your permitted and registered solid waste management facilities.

For facilities at which multiple activities or operations occur (e.g., transfer stations, construction and demolition debris processing, recyclables handling & recovery, etc.) please complete the appropriate forms for each of these activities. If you have any questions about which forms to use, please contact the DEC Regional Office for the Region in which your facility is located or contact the Central Office at (518) 402-8678.

Submission of the completed form does not relieve you from any additional reporting responsibilities that are identified as special conditions in your 6 NYCRR Part 360 permit or that may be required for inactive or closed facilities, or other types of solid waste management facilities not referenced above.

To complete the annual report submission process:

  1. Download the forms applicable to your facility or facilities.
  2. Print the forms double-sided.
  3. Fill out the Annual Report Form(s) completely and sign the form(s). Planning Units and contact information can be found on the last page of the forms.
  4. Make a copy for your records.
  5. Fax the completed Annual Report Form(s) to the New York State Department of Environmental Conservation's Central Office at (518) 402-9041 or e-mail it to solid waste permits. If you cannot fax or e-mail the form(s) or if there are lengthy attachments to the annual report(s), make a second copy and submit to the Central Office at the address on the top of this letter.
  6. Mail the original completed form(s) to the New York State Department of Environmental Conservation (NYSDEC) Regional Office that has jurisdiction over your facility.

Other questions regarding your reporting responsibilities should be directed to your respective Regional Office.

Failure to submit the Annual Report Form is a violation of 6 NYCRR Part 360 and can result in a penalty of up to $7,500 per violation and an additional penalty of up to $1,500 per day that the violation continues, as specified in ECL 71-2703.

Anaerobic Digester Annual Report Form (PDF) (12 kB) - an anaerobic digester facility is a digester that normally handles a combination of animal manure, food processing waste and grease/cooking fats to produce methane and a liquid effluent that can be land applied on farms. The methane can be used as fuel to generate heat for existing facilities.
  3. Biosolids Composting Facility Annual Report Form (Permitted) (PDF) (97 kB) - a biosolids composting facility is a facility used to provide aerobic, thermophilic decomposition of solid waste (sewage sludge, septage, mixed solid waste, etc.) to produce a stable, humus-like material.
  4. Biosolids Land Application Facility Annual Report Form (Permitted) (PDF) (109 kB) - a biosolids land application facility is a facility where solid waste (sewage sludge, septage, mixed solid waste, etc.) is applied to the soil surface or injected into the upper layer of the soil to improve soil quality or provide plant nutrients.
  5. Biosolids Processing Facility Annual Report Form (Permitted) (PDF) (101 kB) - a biosolids processing facility is involved in the processing of readily biodegradable organic components in solid waste to produce a mature product for beneficial use as a source of nutrients, organic matter, liming value, or other essential constituent for a soil or plant. The processes include, but are not limited to, heat drying, and chemical stabilization.
  6. Composting Facility for Food Processing Waste Annual Report Form (Registerd) (PDF) (245 kB) - a composting facility for food processing waste breaks down or decomposes waste (such as wasted fruits and vegetables fro a proessor) into organic materials that can be used as a soil amendment or growing medium. These registered facilities are regulated under Subpart 360-5 of Part 360. ***new report for 2012***
  7. Composting Facility for Food Waste or Other Source-Separated Organic Waste Annual Report Form (Registerd) (PDF) (244 kB) - a composting facility for food waste or other source separated organic waste (SSOW) breaks down or decomposes SSOW (typpically food waste) into organic materials that can be used as a soil amendment or growing medium. To qualify for registration under Subpart 360-5 of Part 360, the facility can accept no more than 1,000 cubic yards of SSOW per year. ***new report for 2012***
  8. Composting Facility for Yard Waste Annual Report Form (Registerd) (PDF) (243 kB) - a composting facility for yard waste breaks down or decomposes yard waste (typically leaves, grass clippings, small branches) into organic materials that can be used as a soil amendment or growing medium. To qualify for registration under Subpart 360-5 of Part 360, the facility can accept between 3,000 cubic yards and 10,000 cubic yards of yard waste per year. ***new report for 2012***

Construction and Demolition Debris Processing Facility Annual Report Form (PDF) (315 kB) - a construction and demolition debris processing facility is a facility that receives and processes construction and demolition debris for recovery, transfer or disposal.   11. Household Hazardous Waste Collection and Storage Facility Annual Report Form (PDF) (126 kB) - a household hazardous waste collection and storage facility collects and stores hazardous waste generated from households.
  12. Land Clearing Debris Landfill Annual Report Form (PDF) (274 kB) - a land clearing debris landfill is three acres or less and is used only for the disposal of vegetative matter, soil and rock resulting from activities such as land clearing and grubbing, utility line maintenance, or seasonal or storm-related cleanup such as trees, stumps, brush and leaves and including wood chips generated from these methods.   16. Non Recognizable Food Processing Waste Land Application Annual Report Form (Registerd) (PDF) (241 kB) - a land application facility for non recognizable food processing waste is registered to land apply non recognizable foor processing waste such as whey. ***new report for 2012***
  17. Recyclable Handling and Recovery Facility Annual Report Form(PDF) (303 kB) - a recyclable handling and recovery facility is a processing facility at which nonputrescible recyclables are separated from the solid waste stream or at which previously separated nonputrescible recyclables are processed. Regulated Medical Waste/Radiopharmacy Storage and Transfer Facility Annual Report Form (PDF) (283 kB) - a regulated medical waste/radiopharmacy storage and transfer facility is a facility that compounds and dispenses radiopharmaceuticals and stores and transfers regulated medical waste/radiopharmaceuticals.

  20. Septage Land Application Annual Report Form (Registerd) (PDF) (241 kB) - a land application facility for residential septage is registered to land apply only residential septage. To qualify for registration, no more than two trucks belonging to one hauler can be used. ***new report for 2012***
  21. Septage Storage Facility Annual Report Form (Registerd) (PDF) (241 kB) - a septage storage facility is a facility registered for the storage of residential septage in holding areas such as lagoons or tanks that are registered under Subpart 360-4 of Part 360. ***new report for 2012***
  22. Source-Separated Organic Waste Composting Facility Annual Report Form (Permitted) (PDF) (89 kB) - a source-separated organic waste composting facility is a facility that composts readily degradable organic material that has been separated from non-compostable material at the point of generation including, but not limited to, food waste, soiled or unrecyclable paper, and yard waste in combination with any of the former materials. It does not include biosolids, sludge, or septage.
  23. Storage Facility for Non Recognizable Food Processing Waste and Manure Annual Report Form (Registerd) (PDF) (242 kB) - a storage facility for non recognizable food processing waste and manure is for manure storage facilities that also contain non recognizable food processing waste (NFPW) (e.g. whey, etc). These facilities can accept up to 40% of the total volume put in the storage structure on an annual basis as NFPW. ***new report for 2012***

  25. Waste Fluid Disposal Annual Report Form (PDF) (91 kB) - used by exempt scrap metal processors, metal salvage facilities, and facilities that recover metal from sludges to report how waste fluids are disposed and the amount of material received at the facility.
  26. Waste Tire Storage/Processing Facility Annual Report Form (PDF) (187 kB) - a waste tire storage/processing facility stores/processes whole tires or portions of tires.
  27. Yard Waste Composting Facility Annual Report Form (Permitted) (PDF) (12 kB) - a yard waste composting facility composts leaves, grass clippings and garden debris.
