NYSDEC Certifies Cleanup Requirements Achieved at 1132-1146 Seneca Street Site in Buffalo
The New York State Department of Environmental Conservation (NYSDEC) has determined that cleanup requirements at the 1132-1146 Seneca Street Site, located on Seneca Street in the City of Buffalo, have been achieved.
NYSDEC approved a Final Engineering Report that documents the cleanup actions performed at the site and issued a Certificate of Completion to Flexo Transparent, Inc. and RSB Enterprises. A copy of the Certificate of Completion, which certifies that the site has been properly cleaned up and made suitable for redevelopment, is available at the locations identified in this fact sheet.
What Cleanup Actions Were Performed?
An environmental cleanup action was performed in 2009-2010 to remove approximately 4,775 tons of contaminated soil. The environmental cleanup involved:
- Removal and offsite disposal of polychlorinated biphenyl (PCB) contaminated soils;
- Removal and offsite disposal of semi-volatile organic compound (SVOC) contaminated soil;
- Removal and offsite disposal of underground storage tank and contaminated water/soils;
- Restoration of the site by backfilling excavations with clean soils;
- Limiting the use of the site for industrial purposes by placing an environmental easement on the property;
- Developing and implementing a Site Management Plan to ensure the site controls are maintained.
The cleanup actions successfully addressed contamination, and NYSDEC approved the Final Engineering Report and Site Management Plan in December 2010. The Certificate of Completion was also issued in December 2010.
Are Controls In Place to Ensure Continued Protection of Public Health and the Environment?
Institutional controls and engineering controls are designed to reduce or eliminate exposure to any remaining contaminants of concern. An institutional control is a non-physical restriction, such as an environmental easement, placed on use of the site when contamination left over after the cleanup action makes the site suitable for some, but not all uses. An engineering control is a physical barrier or method, such as a vapor barrier, to manage contamination.
The following institutional controls have been put in place on the site:
- Prohibiting the use of site groundwater for potable use; and
- Implementing a Site Management Plan and Environmental Easement which restricts the use of the site.
No additional steps are necessary. NYSDEC issued the Certificate of Completion based on review and approval of a Final Engineering Report submitted by the applicant. The Final Engineering Report includes:
- A description of the cleanup activities completed;
- Certification that cleanup requirements have been achieved for the site;
- A description of any institutional/engineering controls to be used; and
- Certification that a site management plan for any engineering controls used at the site has been approved by NYSDEC.
The Site encompasses approximately 4.2 acres and is located on the northern/northeastern side of Seneca Street in a predominantly mixed industrial, commercial and residential area of south Buffalo, New York. The Site has been used for industrial purposes, including an electrical transformer repair facility. Previous releases of PCBs by a previous site owner impacted the Site. Flexo purchased the property to voluntarily cleanup and redevelop the Site for light industrial purposes.
