Cleanup Activities Completed at 915 Cleveland Avenue Site; Final Engineering Report and Decision Document Under Review

Introduction

The New York State Department of Environmental Conservation (NYSDEC) is pleased to announce that remediation of the 915 Cleveland Avenue Site in Niagara Falls has been completed. Remediation refers to actions taken to eliminate, abate, or contain contamination that may be harmful to public health, welfare, or the environment. The remediation addressed elevated levels of petroleum products, solvents and metals in site soils and groundwater.

Cleanup work at this site was performed under New York State's Brownfield Cleanup Program (BCP), a program that promotes redevelopment by encouraging private companies and developers to identify, investigate, and ensure the cleanup of sites where significant amounts of hazardous waste may exist. CLP3, LLC, the BCP Applicant, has completed the necessary investigation and remedial activities at the site.

Details about the remediation are provided in a document called the Final Engineering Report (FER). It states that cleanup requirements have been achieved, and the remedy is fully protective of public health and the environment. The Decision Document concludes that no further cleanup actions are necessary at the site. The FER and Decision Document are currently under review by the NYSDEC. The Decision Document is available for public review at the locations listed in this fact sheet and in PDF format under Important Links in the right column of this page.

Details of the Final Engineering Report

The Final Engineering Report has several purposes. The report:

  • Describes the cleanup activities completed;
  • Certifies that cleanup requirements have been achieved or will be achieved for the site;
  • Describes any institutional/engineering controls to be used. An institutional control is a non-physical restriction on use of the site, such as a deed restriction, when contamination left over after the cleanup action makes the site suitable for some, but not all uses. An engineering control is a physical barrier or method to manage contamination, such as a cap or vapor barrier; and
  • Certifies that a site management plan for any engineering controls used at the site has been approved by NYSDEC.

The following cleanup activities were completed at the site and are described in the Final Engineering Report:

  • Excavating and on-site staging of non-impacted surface soil;
  • Excavating solvent- and metals-impacted soil;
  • Removing and properly disposing four underground storage tanks;
  • Sampling the sidewalls and bottom of the excavation to ensure that contaminant concentrations were at or below standards protective of public health and the environment;
  • Transporting and disposing impacted soils at registered waste disposal facilities;
  • Placing non-impacted soils and gravel in the excavation areas; and
  • Installing a sub-slab soil vapor venting system within the Municipal Complex building to address any residual volatile organic compound contamination that may remain within the groundwater or bedrock at the site.

Next Steps

NYSDEC will complete its review and require revisions to the Final Engineering Report and Decision Document as necessary. The approved FER and Decision Document will be made available to the public. After all other program requirements are satisfied, the NYSDEC will issue a Certificate of Completion to the applicant and notify the public through a fact sheet similar to this one. The site will then be suitable to be redeveloped for residential purposes.

Site Background

The site is a portion of the recently built Niagara Falls Municipal Complex, which is approximately 0.75 acres. It is bound by Cleveland Avenue to the north, Main Street to the west, and portions of the recently built Niagara Falls Municipal Complex to the east and south. The site is located 0.2 miles from the Niagara River. The site and the surrounding area were historically used for commercial and residential purposes, including an auto repair/service facility, multiple dry cleaning facilities, multiple retail stores, multiple beauty shops and a millinery. Previous releases of dry cleaning agents and petroleum have impacted the site.
