NYS DEC is proposing to amend Part 218 to incorporate California's latest revisions to its low emission vehicle (LEV) III greenhouse gas (GHG) program. The proposed amendment clarifies the deemed to comply provision for model years 2021-2025, which allows vehicle manufacturers to demonstrate compliance with federal GHG standards in lieu of California's more stringent standards. The deemed to comply provision is being revised in response to the United States Environmental Protection Agency's (US EPA) stated intent to freeze and roll back existing GHG standards for model years 2021-2025. Further, NYS DEC proposes to submit the Part 218 as well as the revisions to Part 200 to US EPA as a revision to the State Implementation Plan (SIP) for New York State.

Written comments on the proposed rule may be submitted until 5:00 p.m. on March 18, 2019 to the contact listed above.

DEC invites the public to comment about a proposed remedy to address contaminated groundwater related to the Former Aluminum Louvre Corp. Site (Old Bethpage, Nassau Co.), within New York's State Superfund Program. Public comments about the proposal will be accepted through March 18, 2019.

A public meeting also will be held: February 26, 2019 at 7:00 PM at Farmingdale Public Library, 116 Merritts Road, Farmingdale, NY 11735.
