NYSDEC Invites Public Comment About Cleanup Proposal for State Superfund Site on Evans St., Batavia

The above link (URL) opens a fact sheet that invites public comment about a proposed remedy to address contamination related to the Former Batavia MGP site #819019 (Batavia, Genesee County), within New York's State Superfund Program.

NYSDEC is accepting public comments about the proposal through May 22, 2019

NYSDEC also has scheduled a public meeting on April 30, 2019 at 7:00 PM at Richmond Memorial Library, 19 Ross Street, Batavia, NY  14020 to discuss the proposed remedy and accept public comments.  Please see fact sheet for details about the proposed remedy, meeting, and comment period.

DEC is revising Part 226 Solvent Metal Cleaning Processes and attendant changes to Part 201 to establish lower VOC limits to cold cleaning solvents and remove the stipulation that they only apply to the cleaning of metal. It will also be re-designated Subpart 226-1 to accommodate the addition of a new rule, Subpart 226-2 Industrial Cleaning Solvents, which establishes VOC content limits for cleaning solvents used in operations not covered by other regulations.

DEC is revising Part 208 Landfill Gas Collection and Control Systems for Certain Municipal Solid Waste Landfills, and attendant revisions to Part 200 General Provisions, to incorporate the new federal EG for MSW Landfills codified under 40 CFR Part 60, Subpart Cf. The new federal EG is designed to reduce emissions of landfill gas containing non-methane organic compounds and methane by lowering the emission threshold at which a landfill must install and operate a landfill gas collection and control system. Once this proposal is adopted, DEC is required to revise its State Plan to reflect the new EG and submit the State Plan to EPA for review and approval.

Hearings for the proposed rule and attendant revisions to existing rules described above will be held as follows and are scheduled in places that are reasonably accessible to persons with impaired mobility.

Akron Quarry -- County Line Stone Co., Inc.

A public comment hearing for the receipt of public comments on the permit application and Draft EIS will be held on May 22, 2019 at 6:00 p.m. at the Village of Corfu Community Center, 116 East Main Street, Corfu, New York  14036.

County Line Stone Co., Inc. - Notice of Public Comment Period, Notice of Public Comment Hearing, Notice of Acceptance of Draft Environmental Impact Statement, Notice of Complete Application -- The proposed action involves the expansion of the Akron Quarry, including mining of new areas of land (which is approximately 90.3 acres of excavation) and overburden storage areas (approximately 20.9 acres) adjacent to the existing approved mining area.  The total acreage included in this application, but not previously approved is 111.2 acres.  The new excavation areas will be along Crittenden and Schurr Roads in the Town of Newstead and along the east side of the quarry in the Town of Pembroke.

All written filed comments and electronically submitted comments must be received no later than 5:00 p.m. on May 31, 2019.

DEC invites the public to learn more about the status of Lake Erie and Upper Niagara River fisheries at a public meeting on Wednesday, May 22, from 6:30 p.m. to 9:30 p.m. at The Lodge at Woodlawn Beach State Park, 3580 Lake Shore Road, Blasdell, New York  14219.

The meeting will begin with an informal discussion, followed by a series of presentations on Lake Erie and Upper Niagara River fisheries topics, and will include opportunities for discussion on a variety of fisheries management activities.  Key members of Lake Erie and Niagara River's fisheries management and research community will present information on management and assessment activities for prominent Lake Erie sport fisheries.

No registration is required to attend this free event.
