Freshwater Wetlands Appeals Board
The New York State Freshwater Wetlands Appeals Board is an independent appellate body which hears and decides challenges to regulatory decisions made under the Freshwater Wetlands Act (Article 24 of the New York State Environmental Conservation Law).
The general mission of the Board is to provide individuals with a more accessible and specialized forum for their appeal than can be found in supreme court. Since DEC enforces the Freshwater Wetlands Act in New York State, most appeals before the Board challenge DEC decisions. Decisions of the Board are subject to appeal pursuant to Article 78 of the Civil Practice Law & Rules by either the appellant or the responding agency.
