Duties/Responsibilities The Associate Attorney's primary duties will include: reviewing and responding to administrative appeals under the Freedom of Information Law (FOIL), and advising and assisting Department Staff on a wide range of issues involving contracts and grants, including procurement, vendor responsibility, bid protests, negotiation, administration, amendment, and termination of contracts and grants, and legal review of contracts and grants prepared by Department Staff. The Associate Attorney will handle enforcement work and will act as a liaison with the Attorney General on litigation related to FOIL appeals, contracts and grants. The Associate Attorney may be assigned other duties depending on the workload.

Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.

Transfer Eligible - One year of permanent competitive service at Salary Grade 26 or higher and either:
Eligible for transfer under Section 52.6: Must have current or prior service in a title designated as 52.6 within two salary grades\one M grade of this position and possess the appropriate license. To determine if your title is designated as 52.6 go to the Department of Civil Service website http://www.cs.ny.gov/ and search for your title under GOT-IT.

Duties/Responsibilities The Associate Attorney (SG28) will act as Chief of Section A in the Remediation Bureau in the Office of General Counsel. Section A has primary legal responsibility for programs: inactive hazardous waste disposal sites (State Superfund); Brownfield Cleanup Program (BCP); RCRA Corrective Action; and the Environmental Restoration Program (ERP). The Associate Attorney will work with programs in developing policy and determining how applicable laws, regulations and policies are implemented. The position will supervise at least five staff members and serve as a resource available to other programs and around the State on remedial program matters and will also maintain communication with the Section Chief for Section C, the Natural Resource Damages Section, regarding cases that affect both programs. The Associate Attorney will also be responsible for handling a docket of cases.
