Duties/Responsibilities

Must be able to work well with others and to change priorities at any given time. The Associate Attorney will report to the Regional Attorney/Associate Counsel and will serve as the lead attorney on high-profile and significant cases, including those with multi-agency (state and federal) and multi-region involvement, along with cases having precedential impact, as directed by the Regional Attorney. The Associate Attorney will supervise Region 9 Senior Attorneys and legal interns who are called on to assist with these high-profile and significant cases, and may supervise Senior Attorneys on other matters as needed. In addition to working on high-profile cases, the Associate Attorney will analyze legal issues in enforcement and permit matters, prepare consent orders, pleadings, briefs, conduct legal research, represent the Department at administrative proceedings, including issuance of permits and enforcement of environmental laws and regulations, and assist the Attorney General's Office or Department of Justice in judicial proceedings as needed. The Associate Attorney will also prosecute criminal cases involving ECL violations when requested and authorized by District Attorneys.

2 Years of service as a Senior Attorney or Senior attorney (Various Parenthetics)

Reassignment - Currently in the title and an employee of DEC
or

Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.
or

Transfer Eligible - One year of permanent competitive service at Salary Grade 26 or higher and either:
Eligible for transfer under Section 52.6: Must have current or prior service in a title designated as 52.6 within two salary grades\one M grade of this position and possess the appropriate license. To determine if your title is designated as 52.6 go to the Department of Civil Service website http://www.cs.ny.gov/ and search for your title under GOT-IT.

If you are on an examination eligible list for the position title, you do not need to respond to this posting UNLESS you are also eligible for appointment by transfer, reinstatement or reassignment as defined above; or the appointment type is provisional or temporary. Additional Comments The examination for this title is currently announced; applications to take the examination must be submitted to Civil Service by August 27, 2014. If applying for provisional appointment: In order for you to be considered for a permanent/contingent permanent appointment, you must apply for and take the examination for this title, and your score must be high enough to qualify you as one of the top three acceptors on the resulting list. If you are not successful on the examination, or your score is not high enough to be reachable for appointment, your employment in this title will not be allowed to continue.
